Official Rules

NO PURCHASE OR PAYMENT OF SPONSOR’S PRODUCT IS NECESSARY TO ENTER OR WIN. A PURCHASE OF SPONSOR’S PRODUCT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. BY ENTERING IN THE SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES.

1. ELIGIBILITY: Chevy Fill My Tank Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or have reached the age of majority (whichever is older in state of residence) at the time of entry. Employees of General Motors LLC, Jack Morton Worldwide, Inc., Genesco Sports Enterprises, Inc., and their parent and affiliate companies (collectively, “Sweepstakes Entities”), and its affiliates and each of their respective employees, shareholders, officers, directors, agents, members, successors and assigns, as well as their respective immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households (whether related or not) are NOT eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes.

2. SPONSOR: General Motors LLC, 100 Renaissance Center, Detroit, MI 48265. ADMINISTRATOR: Genesco Sports Enterprises, Inc., 5944 Luther Lane, Suite 500, Dallas, TX 75225.

3. SWEEPSTAKES PERIOD: The Sweepstakes begins on Saturday, July 18, 2020 at 12:00:00 AM Eastern Time (“ET”) and ends on Friday, October 2, 2020 at 11:59:59 AM ET (“Sweepstakes Period”) and consists of eleven (11) entry periods (each an “Entry Period”) as outlined in the chart below:

Non-winning entries will carry-over into subsequent Entry Period drawings. The time clock of the computer administering this Sweepstakes is the official clock for this Sweepstakes.

4. TO ENTER: During the Sweepstakes Period, an eligible entrant (“Entrant”) may enter by visiting http://www.chevyfillmytank.com (“Website”) and following the online instructions to complete and submit all necessary fields of the entry form, including, but not limited to, his/her first and complete last name (no initials), email address, phone number, street address (no P.O. Boxes will be allowed), city, state, and zip code (“Entry”), to receive one (1) Entry into the Sweepstakes. By entering the Sweepstakes, Entrant agrees to be bound by these Official Rules.

LIMIT: There is a limit of one (1) Entry per person per day during the Sweepstakes Period. If an Entrant enters more than one (1) time per day, only the first Entry for such day will be included in the Sweepstakes. Additionally, Entrants may only win one time throughout the entire Sweepstakes Period.

IMPORTANT: MESSAGE AND DATA RATES MAY APPLY IF AN ENTRANT ENTERS THIS SWEEPSTAKES ON HIS/HER MOBILE DEVICE. NOT ALL MOBILE TELEPHONE/WIRELESS PROVIDERS CARRY THE SERVICE NECESSARY TO PARTICIPATE IN THIS SWEEPSTAKES. ENTRANTS SHOULD CONSULT THEIR WIRELESS PROVIDER’S PRICING PLANS. MOBILE ENTRY IS NOT REQUIRED TO ENTER OR WIN A PRIZE IN THIS SWEEPSTAKES.

5. PRIZING (96 total): Each winner (eight [8] in each Entry Period) will receive one fifty dollar ($50) Visa gift card (“Prize”). Approximate Retail Value (“ARV’) per Prize: $50. Total ARV: $4,800. All other expenses relating to acceptance of the prize not explicitly stated herein, including but not limited to taxes, meals, transportation, lodging, are the responsibility of the winner. Sponsor is not responsible if event is delayed, postponed, or canceled for any reason. Gift cards are subject to issuer’s terms and conditions.

No transfer, assignment, cash redemption, or substitution of a prize is permitted, except by Sponsor, who reserves the right to substitute a prize for a prize of comparable or greater value, in Sponsor’s sole and absolute discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied, by Sponsor and without liability to Sponsor for the unsafe operation and use thereof. Winners are responsible for all taxes and fees associated with prize receipt and/or use, including but not limited to, all local, state, federal, and income taxes. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. Actual value of the prize may vary. Winner will not receive difference between actual value of the prize and ARV. No more than the stated number of winners in these Official Rules will be awarded.

6. WINNER DETERMINATION: On or about each of the drawing dates indicated in the chart above in Section 3, Sponsor’s representatives will randomly select eight (8) potential winners from among all valid entries received, provided a sufficient number of entries are received during each Entry Period. Each winner is considered a potential winner pending verification of his/her eligibility and compliance with the Official Rules. Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Potential winners will be notified via email at the email address provided at the time of registration and may be awarded the prize. The potential winners will have twenty-four (24) hours to accept or reject the prize. Potential winners will be required to complete and return an affidavit of eligibility, liability release, and except where prohibited by law, a publicity release form within twenty-four (24) hours of receipt.  If the potential winners’ notification is rejected, returned, or deemed undeliverable or a potential winner fails to execute and return the affidavit/release within the specified time or if he/she is otherwise ineligible to receive the prize, that potential winner will be deemed ineligible and the prize will be awarded to an alternate selected at an alternate drawing from all remaining eligible entries. If applicable, winners may receive an IRS Form 1099 for the retail value of the prize.

7. RELEASE: By receipt of the prize, winners agree to release, defend and hold harmless Sweepstakes Entities, promotional partners, and each of their respective subsidiaries, affiliates, limited liability companies, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each of their respective officers, shareholders, directors, members, employees, licensors, successors, assigns and agents (collectively, “Released Parties”) from and against any claim or cause of action, including but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes, either directly or indirectly, or from acceptance, possession, misuse or use of any prize.

8. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s, its agents’, and promotional partners’ use of winners’ name, likeness, photograph, voice, image, statements, biographical information, opinions and/or hometown and state at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet, without review, notification, or approval, and additional payment or consideration, unless prohibited by law.

9. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s or Administrator’s reasonable control impairs the security, fairness, integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Released Parties are not liable in the event that any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, epidemic or pandemic, federal, state, or local government order, or any other condition beyond their control (a “Force Majeure Event”).

10. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) lost, late, mutilated, illegible, unintelligible, incomplete, misdirected or postage-due mail or Entries; (2) Entrant’s participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes; (3) hardware or software errors, faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; (4) errors or limitations of any Internet or wireless providers, servers, hosts or other providers; (5) garbled, jumbled or faulty data transmissions; (6) failure of any online transmissions to be sent or received; (7) lost, late, delayed or intercepted transmissions; (8) inaccessibility of the Website in whole or in part of any reason; (9) traffic congestion on the Internet or Website; (10) unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs or worms; (11) destruction of any aspect of the Sweepstakes; or (12) loss, miscount, misdirection, in accessibility or unavailability of an email account used in connection with the Contest. Sponsor and Administrator are not responsible for any typographical, technical, computer, network or human errors which may occur in the administration of the Contest; the uploading, processing or judging of Entries; or the announcement of the prizes in any Contest-related materials. Use of Website is at Entrant’s own risk. Sponsor and Administrator are not responsible for any personal injury or property damage or losses of any kind which may be sustained to Entrant’s or any other person’s computer or web-enabled device resulting from participation in the Contest.  If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

11. DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions regarding the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

12. SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability or any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.

14. WINNER’S LIST: For a winners’ list, mail a self-addressed, stamped envelope to: “Chevy Fill My Tank Sweepstakes,” 5944 Luther Lane, Suite 500, Dallas, TX 75225. Winners’ list requests must be received by December 15, 2020.

15. NAME REMOVAL NOTIFICATION SYSTEM: If you would like your name removed from Sponsor’s mailing list, please send your name and address to Chevrolet 100 Renaissance Center 482.AAO.MAR Detroit, MI 48265 or call 1-800-222-1020 and your name will be removed within 60 days of the request.
